Terms of Service

Please read these Terms of Service ("Terms") carefully before using the DiveSlate mobile application or website (the "Service") operated by DiveSlate ("we," "us," or "our").

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and DiveSlate. You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement and that you have the legal capacity to enter into this agreement.

2. Description of Service

DiveSlate provides dive condition forecasting information derived from publicly available weather, oceanographic, and tidal data sources. The Service is intended as a planning aid to help divers assess current and forecasted conditions.

Important: DiveSlate provides informational estimates only. Conditions data is aggregated from third-party APIs and may be inaccurate, delayed, or incomplete. Always conduct your own assessment of conditions before entering the water. DiveSlate is not a substitute for proper dive training, dive planning, or in-person observation of conditions.

4. Subscriptions, Purchases & Billing

DiveSlate offers the following paid plans in addition to the free tier:

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You may manage or cancel your subscription through your App Store or Google Play account settings.

All prices are in USD and are subject to change. We will provide reasonable notice of any price changes before they take effect.

5. Refund Policy

Purchases made through Apple App Store or Google Play are governed by those platforms' respective refund policies. For direct purchases, refund requests made within 14 days of purchase may be submitted to [email protected] and will be considered on a case-by-case basis.

The DiveSlate application, including its name, logo, Dive-Ability Score methodology, design, and all content created by us, is owned by DiveSlate and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use.

Underlying weather and oceanographic data is sourced from public APIs. We do not claim ownership of that raw data.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, DIVESLATE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that condition data will be accurate or current. Marine conditions can change rapidly; always exercise independent judgment before diving.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIVESLATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF DATA.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO DIVESLATE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $10.00 USD IF YOU ARE A FREE USER.

10. Indemnification

You agree to indemnify and hold harmless DiveSlate and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination (including ownership, disclaimer of warranties, and limitation of liability) will survive.

12. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Florida for resolution of any disputes arising from these Terms.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
